Jason Sechrest Releases 'Top 10' Male, Females Stars of 2006

LOS ANGELES – Sex talk radio host Jason Sechrest, aka Jason Curious, released his "Top 10" list for 2006 of the most popular male and female porn stars on his website, JasonCurious.com.

With his website tracking software, Sechrest was able to compile a list of which stars received the most pages hits, which he says is “always more than telling when it comes to breaking through the hype to recognize those who are truly the most sought after stars of the year.”

Sechrest also noted that “The Top 10 Most Popular Men and Women of 2006” ranges from brand new stars to retired ones, and truly reflects the range of men, women and transsexuals that surfers want to look at, regardless of their most recent work.

Google More Popular Web Destination than Yahoo

CYBERSPACE -- The great website destination wars are by no means over, but the position of the major players has shifted slightly. Although Microsoft remains the most frequently visited website on the internet, the second most popular site has changed.

According to ComScore Networks, in November search engine Google knocked previous second-place holder Yahoo out of position and is narrowing the distance between it and the international computer technology corporation.

Rising 9.1-percent from the year before, Google saw a total of 475.7 million visits during November. Yahoo, on the other hand, only saw an increase of 475.3 million, a 5.2-percent increase over the previous year. ComScore Networks reports that this is the first time that the Mountain View, CA-based Google has surged ahead of its Sunnyvale, CA-located search engine rival, something the research firm says may be a result of Google's increasing international appeal.

Although Microsoft racked in 501.7 million visitors in November, up 3.3-percent from November of 2005, ComScore Networks says that Yahoo remains the single most frequently visited site within the United States.

Other movers include a nearly fivefold increase in visits to Fox Interactive Media sites, with 130.4 million in November, something likely associated with the News Corporation purchase of MySpace.com. Likewise, Google's newest $1.65 billion toy, YouTube.com, saw its popularity jump by nearly 25-fold, to 107.9 million visits during November.

New Site From Tera Patrick

CYBERSPACE — Tera Patrick launched her official fan website, TeraMania.com, this week.

TeraVision CEO Evan Seinfeld said that the new site will complement Patrick's primary site, ClubTera.com.

"Tera Mania is a special site we built for the fans," Seinfeld told XFANZ. "It's a place to get special autographed stuff directly from Tera."

The site offers fans personally autographed merchandise from Patrick, including movie posters, calendars, photographs and DVDs. Seinfeld said that he expects a quick turnaround on orders, depending on demand.

Despite the promise of a fast turnaround, though, Seinfeld stressed that Patrick will take the time to add a personal touch to every item she signs.

InterBill Faces U.S. Suit Over Alleged Bogus Website

LAS VEGAS — Third-party processor InterBill Ltd. facilitated an online company’s alleged fraudulent scheme by collecting consumer bank account numbers and then debited funds from thousands of bank accounts, according to court documents obtained by XBIZ.

InterBill, which markets its services to online adult companies, was sued by the Federal Trade Commission Tuesday for attempting to collect $9.9 million in a three-month period in 2004 through an alleged fraudulent website.

That site, PharmacyCards.com, purportedly sold discount prescription cards. Many of the country’s largest retail pharmacies — Krogers, Wal-Mart and Target — were listed on the site, but none ever gave permission to use their name or logos, according to the suit.

The FTC contends that InterBill collected consumer information and debited $139 from each without performing any service or seeking authorization from customers.

The suit further claims that InterBill and company officer Thomas Wells were able to use customer bank accounts to create demand drafts or electronic checks and submit them for deposit into a Las Vegas Wells Fargo Bank account.

Wells, according to the complaint, struck a revenue-sharing deal with PharmacyCards in 2004. But the government says that Wells knew that the deal was nefarious because he revealed in communications to PharmacyCards operators that many of their transactions would be reversed.

“Going into this project we discussed 40-45 percent being the max [rate of reversed debits] that we could tolerate,” Wells was quoted in an email exchange with PharmacyCards operators.

PharmacyCards operates with a London post office box and conducts all its business through prepaid cellular phones, free email and free facsimile accounts, according to the complaint.

In a previous court filing, the FTC said the company is operated by David Graham Turner, who also operates 3rd Union Card Services Inc.

Shortly after commencing the deal, Wells received numerous complaints from banks and even from a customer services call center in Montreal that was set up to “assist” PharmacyCards customers.

Nearly 70 percent of the consumers defrauded by PharmacyCards and InterBill, however, were able to contest their charges, according to the complaint.

Despite the contested charges, InterBill still was able to deposit 30 percent of the funds, earning $2.38 million. “The PharmacyCards operators used the identity of a Cyprus corporation and directed that their funds be wired to a Cyprus bank account, a known tax haven,” the complaint reads.

The FTC seeks a permanent injunction, attorneys fees and $9.9 million in restitution from InterBill for the alleged fraudulent operation between the two companies.


XBIZ was unable to reach Wells or any other official from InterBill on Thursday. The company has offices in Las Vegas, London and Great Neck, N.Y., according to its website.

Report: Vista Flaw Could Affect MS Exchange Mail Server

REDMOND, Wash. — Another Microsoft operating system rollout, another set of stinging critiques.
The long-awaited update to the Windows operating system — Microsoft Vista — has been found to have a plethora of flaws, including one flaw that makes it possible for an attacker to repeatedly disable a Microsoft Exchange mail server simply by sending the program an infected email message.
That flaw was found by software protection firm Determina, which made a blanket statement that attackers can inject rogue software into Vista-based computers.
Determina found five vulnerabilities, including one error in the software code underlying the company's new Internet Explorer 7 browser.
And just last week, the chief technology officer of Trend Micro said he had discovered an offer on an underground computer discussion forum to sell information about a security flaw in Vista for $50,000, according to a report.
More tech security firms say there is a growing underground market for information that permits attackers to break into systems via the Internet, the officer said.
While Microsoft says it continues to investigate the claims of code errors and flaws, the company finds itself with stiff competition from companies like Google, which has begun offering web-based applications that rival standard desktop software.

FTC Goes After Foreign Spammers

WASHINGTON – In an effort to get a handle on spam, phishing gags and Nigerian rip-off artists, President Bush signed a bill before the Christmas holiday empowering the Federal Trade Commission to further root out email spammers in foreign countries.
The bill, sponsored by Sen. Gordon H. Smith, R-Ore., comes at the same time as a report from email filtering company Postini stating that spam now accounts for 92.6 percent of all email.
With its new spam-fighting jurisdiction under the U.S. Safe Web Act, the FTC can now investigate the origin of email scammers in multiple countries by tracking email servers and other nefarious methods of concealing point of origin, particularly in cases where spammers route their attacks through several different countries. The FTC also can seek assistance from foreign law enforcement.
In response to the passing of the bill, the FTC said it will focus on illegal spam and scam operations originating out of Africa, Southeast Asia and Eastern Europe.
The FTC was formerly able to pursue foreign spammers but not to the extent that it is now.
"Commerce has gone global and so fraud follows," said Lydia Parnes of the FTC's Bureau of Consumer Protection.
The FTC had been lobbying Congress for several years to obtain such unlimited power in the fight against foreign spam operations, and in 2005 it produced a 32-page report making a plea for the power to break through geographic and legal boundaries so far restricted by U.S. law.
Security firm McAfee recently stated that spam has risen at a rapid rate, indicating how much the digital underworld has developed this past year, and with it the higher degree of damage scams or virus-infected email can have on PC users.
"There's less focus on what is the top virus," Paul King, a senior security advisor for Cisco, told the BBC. “To be quite honest it does not really matter because the criminals just do what works."

Adult On The Go

Cherian also has a program called Videora, that lets you download content from BitTorrent (a peer-to-peer media sharing service) and automatically convert it to PSP format. As always, the Japanese are way ahead of us technologically, and since the debut of PSP Video 9, Cherian said that "people in Japan are creating weird little clips already encoded in the PSP format" to distribute through BitTorrent. "They want other people to download and watch [the videos], and they want to get comments and feedback. I think it's going to be pretty popular." So besides being another vehicle for adult content, it looks like the PSP might join the likes of YouTube and MySpace as a vehicle for virally distributed videos.

Nintendo DS So far, Nintendo's dual-screen game system hasn't shown much promise for adult. The system can log onto the World Wide Web, but as of now, only the Opera web browser is available for it, and according to 1up.com, the Nintendo DS "takes painful liberties with page rendering and lacks support for half of the Internet's current standards." Meaning? If you actually manage to download adult content onto your DS, it'll split the images between its two screens. The upside? No pop-up ads.

Apple iPod The video iPod has quickly become one of the gotta-have items of the decade. Apple.com offers more than 3,000 music videos and TV shows for download, and tech-savvy geeks have already started converting their favorite movies to durable, lightweight formats like MP4 for easy storage. The adult biz has followed suit. Adult star and rocker Kurt Lockwood made a point of offering his adult directorial debut for iPod download, and sites like My Mojo and Handheld Porn Sites have already started popping up to offer content for mobile devices, including the iPod. If you're more of a do-it-yourself type, there are also lots of online tutorials about how to convert videos to iPod-friendly formats.

Asian Internet Traffic Slow or Nonexistent After Submarine Lines Severed

TAIPEI — Online adult companies that rely on Asian traffic may take a hit in the coming weeks after a 7.1-magnitude earthquake struck off the coast of Taiwan and severed lines, leaving Internet service painfully slow or nonexistent.
The widespread blackout leaves millions of people from China to Japan to Australia without Internet, as well as phone service, after the vast network of underwater cables went down.
As a Band-Aid, officials from several communications companies say they are attempting to route Internet traffic through Europe because of the sliced submarine lines off the coast of Taiwan.
Lin Jen-hung, a spokesman for Chunghwa Telecom, Taiwan's telecommunications monopoly, said that repairing the undersea cables will take two to three weeks.
Tuesday’s quake and its aftershocks knocked out parts of the SeaMeWe 3 (South East Asia Middle East Western Europe 3) and APCN2 (Asia Pacific Cable Network 2) undersea cables.
Both are major telecommunications arteries in East Asia, and their temporary loss led to the problems being observed on Wednesday. Traffic that traversed the cables has been switched onto alternate routes, but those other cables are now congested.

Wikipedia Founder to Launch User-Driven Search Engine

The Wikia Corporation, a for-profit company created by Jimmy Wales, the founder of the popular user-driven encyclopedia Wikipedia.org, has announced plans to launch a new search engine, financially backed by none other than Amazon.com. The new engine will be powered by you: the user - similarly in the way that Wikipedia is powered by contributions, updates and support of its users.A user-driven search engine would be unlike anything ever seen before in the search market. Google and Yahoo, which are primarily powered by computers and spiders, are excellent at weeding out those who "cheat the system," but because they can't think like a human, have a tough time determining whether or not a site is "good" or "bad". Human-powered search and directory sites such as the struggling DMOZ.org, have also fallen short, as many have been abused by site editors who are often biased when determining search rank and listing status.When humans are involved there is always a chance for error or bias, but the community model, which allows for corrections and multiple-input and review opportunities, as is available at Wikipedia.org, gives the opportunity for multiple points of view, resources and additional information. Hopefully, this opportunity for community input will help The Wikia Corporation's newest project to become successful.This latest project is also a tad different from Wikipedia in that it will definitely be a for-profit venture. With Amazon.com already waiting anxiously in the wings to finance the venture and a host of other technology companies also getting in line to be a part of this project, making a profit won't be a problem. Google and Yahoo have both proved that advertising is the revenue model for search, and Wales says Wikia will definitely be following that same path. They are banking that the unique user-driven aspect of the new engine as well as the already solid reputation of Wikipedia will be enough to attract users away from the other "big guys" on the search engine block.However, some say that it is the commercial aspect and focus of this latest project that will deter many Wiki-supportive users. When advertising was even suggested on Wikipedia, many users balked at the idea, asking why they should contribute for free to a project that someone else will gain profit?Another potential hurdle could be the whole "popularity" aspect of a user-driven system. What is popular is not necessarily "useful" or "meaningful." For example, when the whole Jolie-Pitt baby debacle was in the forefront of the news, it took over prominence on chat boards, blogs and other user-driven services. If that were to happen with a popular site on a user-driven search model, we may very well end up with a lot of sites ranking very high that mirror trends in popular culture, rather than a resource network of useful sites.And what about the abuse factor? Surely SE spammers and rank cheaters will get a kick out of a user-driven model that they can twist and mold to yield them the best results. Will Wikia provide a means to ferret out these cheaters to maintain the integrity of the search?There is a LOT of potential to this idea of a user-driven search, so many opportunities and new doors that could be opened. While it is a sort of Pandora's Box in many ways, perhaps it should be opened as an experiment to reveal both the benefits and the "evils" of such a system so that it can be perfected, improved and hopefully used wisely in the future. If it is done right and with focus, Wikia could have a real winner on their hands - and a possible competitor to Google.

Federal Court Rules Against Adult Video Pirates in Australia

SYDNEY, Australia - On Wednesday, Australia’s Federal Magistrates Court upheld a 2005 judgment against an adult video chain convicted of manufacturing and selling counterfeit DVDs of material produced by the Private Group and distributed by Calvista Australia.
-advertisement-Venus Adult Stores had appealed the court’s August 2005 decision on the grounds that “[Venus’] own illegal conduct represented a defense to liability,” Australia’s Adult Industry Copyright Organization (AICO) reported.
According to the AICO report, the judgment against Venus for copyright infringement includes “damages, court costs, permanent injunctions and delivery-up of films.” Although Wednesday’s ruling granted a minor reduction in damages due to a miscalculation of the value of the pirated discs, “all other matters of the judgment remain unchanged … including substantial additional damages of $85,000 against the Venus companies and their directors,” the report said.
David Newnham, general manager for Calvista Australia, told AVN in May 2006 that “pornography is mostly illegal in Australia so the pirates’ defense was always that they did nothing wrong since adult films weren’t legal anyway.”
“This is a significant result for our members and a big blow to the pirates,” said AICO executive officer Graeme Dunne. “The Appeal Court has also made clear that adult film copyright owners are just as entitled to copyright protection as any other copyright owners, including the full range of legal remedies. AICO welcomes this important decision which clears the way for more actions against those who infringe its members’ copyright.”
“We’re glad to see that this is one more blow against the pirates in Australia and around the world,” said Antigua Pictures president and AICO member Todd Blatt. “We want them to know that Vivid, ClubJenna and all other companies represented by Antigua Pictures and AICO are protected. We will do whatever it takes to go after them vigorously to get monetary settlements on all titles distributed through Antigua Pictures and represented by AICO in Australia.”
Other adult companies involved with AICO include Zero Tolerance, Red Light District, Wicked Pictures, Falcon Studios, Titan, Acid Rain and Colossal Entertainment.

Va. Attorney General Calls for ISP Data Retention

RICHMOND, Va. — Weighing in on the ongoing data retention debate for Internet service providers, the Virginia state attorney general has issued a report saying that ISPs should keep records for lengthier periods of time to help law enforcement track and apprehend criminals online.
Virginia Attorney General Bob McDonnell, who six-months ago launched the Youth Internet Safety Task Force, echoed sentiments expressed by U.S. Attorney General Alberto Gonzales and FBI Director Robert Mueller on the issue of mandatory ISP data retention, but stopped short of giving a specific recommendation.
Instead, the report called for ISPs to commit to keeping data relevant to ongoing investigations. The report also called for the ISPs to join the debate at the national level to help establish a policy on the matter.
According to a CNET News article, the slightly softer suggestions on data retention made by the task force are likely due to the makeup of the body, which includes representatives from local law enforcement agencies, schools, parenting organizations, as well as private companies such as Microsoft, MySpace, Yahoo, AOL and Sony.
“It is the responsibility of business to assist in the apprehension of those who violate the promise of the Internet and prey upon children,” McDonnell said.
Under current law, ISPs must retain data for 90 days when asked to do so by federal law enforcement officials. However, ISP data retention policies vary by company.
ISPs have been reluctant to support mandatory data retention due to the high cost of storing the information as well as concerns over security and privacy.
The task force also offered an alternative to mandatory data retention, calling for improvements in the process whereby law enforcement agencies can request ISPs to hold onto their records.
For its part, the FBI has maintained its strong stance on data retention, and Director Mueller has made clear that he intends to ask Congress to help him standardize and improve data retention policy in the coming year.
The report also calls for “tough new sentences” for those convicted of trafficking in child pornography.

Porn Dialer Scammers Sentenced in Germany

GERMANY -- Two men convicted of using trojan-horse exploits to infect end-user PCs in furtherance of a porn dialer scam have been sentenced to jail time in Germany, according to the German news agency, ADP.The two men, ages 31 and 35, allegedly spread malicious software between July 2002 and September 2003, infecting approximately 100,000 PCs in the process, primarily within Germany.Once in place on the infected PCs, the malware would initiate calls to premium rate 0190 phone numbers linked to porn websites. Unaware that they had dialed into the porn dialer, end users would continue to surf, not realizing they were racking up huge phone charges in the process. Germany’s telecoms then issued bills for the charges, paying commissions to the scam operation, not realizing that the charges were illegitimate.According to ADP, after the dialup scheme was exposed, the German phone system had to be “re-wired to block similar abuse.”The two men convicted Wednesday reportedly were part of a larger gang that netted 12 million Euros (approximately $15.84 million US dollars) through the dialer scam. One man was sentenced to 48 months in prison, while the other received 39 months.The prosecution also sought to force the men to pay 7 million Euros in restitution to their victims, but the court declined to impose the fine.According to ADP, neither side of the dispute is satisfied with the outcome of the trial, and both prosecution and defense intend to appeal.

3rd-Party Processors Could Help Online Adult With New IE Certification

REDMOND, Wash. — In late January, Microsoft Corp.’s Internet Explorer browser will start flagging websites with extended-validation certification in response to phishing attacks.
Once Microsoft activates the feature in version 7 of Internet Explorer in late January, a green bar for “safe” will appear when the browser sees an EV certificate, usually during a transaction or login.
But online adult companies and other small merchants could be spared from the certification process. Those companies that don’t obtain EV certification could still get the green bar, but only through third-party payment processors that are verified.
Microsoft’s new tool complements another filter recently launched that displays a red warning for known phishing sites and yellow for suspicious ones.
Companies that fail to get certification will remain white. But over time, Microsoft is hoping surfers will know to look for a green bar, just like a padlock.
Under the Microsoft plan, VeriSign Inc. and Comodo will be required to make extensive checks before approving such certificates for Internet merchants and financial institutions. They also will have to undergo independent auditing through WebTrust, a service run by trade groups for certified public accountants.
Microsoft guidelines on EV certification include proof of a physical existence, active landline telephone number, legal existence and identity, proof of domain name and authorization from owners or executives of the company.
Businesses in existence for less than three years may be required to also produce evidence they have a valid bank account.
But in many cases, general partnerships, unincorporated associations, sole proprietorships and individuals are barred from getting these certificates.
For some verifications, exemptions are permitted with a letter from a lawyer, notary or accountant. The guidelines include procedures for verifying authenticity.

Solar-Powered Bikini Coming

NEW YORK — Inventor and engineer Andrew Schneider has harnessed the powers of science, sexiness and the sun for one of his latest projects: a solar-powered bikini.
"There is no way I couldn't do this project," he said. "Once I realized it could be done, it had to be done. I also wanted the opportunity to be able to work with renewable and solar energy in a fun, kitschy, and consumer-oriented way."
Here's how it works: It's not a bikini that runs on solar power. It's a bikini that generates solar power. Schneider calls it the iDrink, and its solar cells pump out about 6.5 volts, which can power an iPod Shuffle or a small drink-cooling device.

MAC Congress Promoters Now Focusing on Mobile Web Americas

MADEIRA BEACH, Fla. — Promoters of the Mobile Web Americas conference and expo are lining up speakers for its three-day September show that focuses on integrating web content on mobile devices.
Black Marlin Multimedia Group Inc., which organized two Mobile Adult Content Congress shows in Florida and California, plans a much-larger event this time around in Orlando, Fla.
“Our exhibition space will be at least 20,000 square feet, and we’re hoping for at least 75 exhibitors,” Black Marlin’s Larry Lockhart told XBIZ.
The event, slated for Sept. 18-20, includes a three-track conference, as well as a pre-conference workshop.
“The first track is geared for webmasters and designers who want to learn more about how to mobilize websites, the second focuses on how to monetize sites, and the third is on how to make the mobile web work,” Lockhart said.
Black Marlin’s Dan Garza said that the company is folding much of the MAC Congress material into the show. He also hinted that the company may drop the MAC Congress name altogether to draw a larger, more-diverse audience.
MAC Congress’ first show in January at the Radisson Miami Hotel drew hundreds, but its second show at the Siena Hotel Resort and Casino in Reno, Nev., drew only in the double digits.
Garza told XBIZ that Black Marlin’s new conference name is intended to reach out to a variety of entertainment industries.
“The word ‘mature’ is more well-suited to the mobile business, which is not just about adult content,” Garza told XBIZ. “’Mature’ is more palatable to [mainstream] companies. Even ‘Late night,’ which WAAT Media coined, works.”
While U.S. revenue figures haven’t been released for 2006, mobile adult content brought in only $30 million in 2005. The mobile adult industry still has major hurdles to overcome, from content rating and age verification to lack of marketing channels.
“We think it’s between two to two-and-one-half years that we’ll see U.S. business take off,” Garza said. “One of the reasons we are hosting the show in Orlando is that it’s easier for European businesses to attend.”

Mozilla Releases Critical Updates

"Critical" security updates were released today by the Mozilla Foundation that address vulnerabilities that were discovered in the Firefox browser, Thunderbird e-mail client and the SeaMonkey application suite. The flaws discovered were found in versions, prior to Firefox 2.0.0.1, Firefox 1.5.0.9, Thunderbird 1.5.0.9 and SeaMonkey 1.0.7, according to Mozilla.Those who have auto-updating enabled have likely already received the security updates, however updates can be downloaded directly from http://www.mozilla.org/. The vulnerabilities are a potential exploit for cross-site scripting attacks, which would let malicious attackers launch a remote execution of code on users' computers. Hustler TV Inks Exclusive Deal With Third Degree Films

LOS ANGELES — LFP Broadcasting, the parent company of Hustler TV, signed an exclusive deal to distribute Third Degree Films for video-on-demand and pay-per-view.
Under the terms of the deal, Hustler TV will begin releasing a new Third Degree Film every month starting in January.
LFP Broadcasting President Michael Klein told XBIZ that signing Third Degree, a company known for gonzo-style productions featuring newer female talent, gives Hustler TV a competitive edge in terms of attracting consumers. The studio has performed well on various industry DVD charts, which Klein uses as a barometer for fan demand.

Big Yellow Worm Attacks Symantec

Yep, you heard that right - there's a Big Yellow Worm and it's got its sights set on Symantec Client Security and Symantec AntiVirus. The new worm, dubbed "Big Yellow" is spreading through a published vulnerability in the security and anti-virus programs which - we should point out - are related to the popular Norton Internet Security and Norton AntiVirus, but are definitely not the same thing. The Symantec versions are intended for business networks and Norton is intended for the consumer market. So far, the Norton products have not been affected.The vulnerability was first discovered and published by eEye a security tools and research firm, back on May 24, 2006. It was then patched by Symantec, just a few weeks later on June 12th. The vulnerability resembles a report of bot activity and seeks to take over networked computers to use them in spreading the malware to other systems.To avoid having the Big Yellow Worm on your network, businesses are advised to make sure that they have the latest versions of Symantec installed - and to block port tcp/2967 at the network gateway to minimize the "attackable surface area," according to the experts at eEye. All users are advised to run the Live Update program on Norton and Symantec products periodically rather than rely on the products to just "update themselves," as many times the programs are set to update virus signatures automatically, but not set to update the anti-virus software itself. Symantec has stated that it is aware of the problem. However, they do report that they are not seeing a "widespread distribution of the worm." New Tool to Stop Online Copyright Infringement Unveiled

REDWOOD CITY, Calif. — Picking up where the law has left many copyright holders without recourse, technology firm Attributor Corp. has gone public with a new product that scans billions of web pages at a time to seek out and identify instances of copyright infringement.
The new technology, which was developed by the year-old Silicon Valley startup, could prove to be a tonic for media companies desperate to stop — or at the very least curb — online infringement of their copyrights, a problem they see as without end given the ready accessibility of content through sites such as Google and YouTube.
So far, media companies have managed the problem with a mix of tools, including digital rights management technology, in-house Internet searches for infringement and armies of lawyers churning out cease-and-desist letters.
“We all know that as soon as somebody comes up with a way to secure a piece of property, somebody else will come within days and crack it,” attorney Lawrence Iser told the Wall Street Journal.
Attributor, which developed its product in “stealth mode” over the past year, announced the news publicly today in anticipation of a release early next year. The company also has announced that it has received $10 million dollars in capital to bring its product to the market.
Attributor was founded by Jim Brock, a former Yahoo executive, and Jim Pitkow, a former research scientist at Xerox and PARC.
“We believe that we can provide an infrastructure that will support all kinds of outcomes and remedies, which will align the interests of content owners, content hosts and search engines around legitimate syndication and monetization,” Brock said.
Pitkow, who holds more than 24 patents pertaining to information retrieval, claims to have solved the problem of scanning billions of web pages in one fell swoop using undisclosed technology.
Pitkow said he hopes media companies will purchase the Attributor service and use it as a tool to protect their content without having to resort to litigation.
“If it works, it’s fantastic,” Iser said.
While there is little information about how Attributor actually works, Wall Street Journal reporter Kevin Delaney said its approach is “seemingly more comprehensive” than other companies angling to do the same thing.
“They're real guys who have solved hardcore problems,” said, Ali Aydar CEO of digital music registry firm Snocap. “Content owners I've talked to outside of the music business would love a system, which tells them where their content is being utilized.”
For now, officials at Attributor said they would not monitor peer-to-peer file swapping systems, where a great deal of illegal content is traded. The company also declined to say how often it would update its index, which is a key part of staying on top of postings.

Fans Count Down to AEE

LAS VEGAS — With organizers of the Adult Entertainment Expo hard at work, the countdown to what promises to be a meeting ground for adult fans and the adult industry is well underway.

Bill Gates: DRM Too Complex for Consumers

REDMOND, Wash. — Content distributors who protect their material with digital rights management (DRM) may be doing themselves and their customers a disservice, according to Microsoft boss Bill Gates, who said the technology is simply too complicated for users.
While DRM is designed to put an anti-piracy lock on content by blocking copying and other forms of exploitation, the technology has raised eyebrows with some end users who say they feel limited by the constraints placed on their legally purchased files.
“DRM is not where it should be,” Gates told a group of bloggers at Microsoft’s offices. “We don’t have the right thing here in terms of simplicity and interoperability.”
Suw Charman of Open Rights Group called DRM “bully-boy tactics by the media industry,” and questioned Gates’ position on the issue.
“The problem with DRM is that it is very anti-consumer,” she said. “[It’s a] bit rich of Bill Gates to make his comments given how much DRM is stuffed into Windows Vista.”
Gates told the crowd that incentives for artists, who prefer DRM because it assures them their work is legally protected, are the only real answer to the piracy problem.
According to blogger Michael Arrington, who was at the meeting, Gates told the crowd that music lovers should simply buy CDs legally and rip the music to circumvent restrictive and ineffective DRM protections.
Charman said she disagreed with the technology chief, arguing that DRM could be a viable solution if companies that rely on it do a better job of educating the public and treating consumers fairly.
“Often consumers do not know what restrictions have been imposed on CDs or digital music until after they have bought them,” Charman said. “Apple has been known to change the rules after people have bought tracks.”

British Lawmakers to Outlaw Possession of Child Porn Cartoons

LONDON — British government officials are discussing ways to extend the ban on images of computer-generated children engaged in sexual acts to include mere possession of the offending material, according to a BBC report.
Under current law, only the distribution of the images, which can include hentai cartoons, is illegal.
Home Secretary John Reid said the British cabinet is looking for ways to ban possession of the computer-generated images in an effort to protect children from pedophiles, even though the images themselves contain no actual children.
“Computer-generated images of child abuse are often found by police stored alongside illegal material held by pedophiles,” he said. "Yet, at the moment, while it is illegal to distribute these abhorrent images, it is entirely legal to possess them.”
Reid said there is no higher purpose for government than to protect children.
John Carr of the children’s charity NCH said computer-generated images of children engaged in sexual acts were becoming more widespread.

Merchant Risk to Hold iBill, Etelegate Recovery Seminar

directNIC Demands SlicksNetwork.com Hand Over Model IDs

NEW ORLEANS — In a move that could indicate further scrutiny by domain registrars, directNIC has demanded that TGP operator SlicksNetwork.com hand over model IDs on all performers it suspects are underage.
In an email sent by Intercosmos, directNIC’s parent company, and obtained by XBIZ, law clerk Juli Silver Green requested that SlicksNetwork.com submit all state issued photo IDs that clearly show the face and date of birth of the models.
Green threatened the site with closure if the site’s publisher doesn’t comply by Dec. 18. DirectNIC imposed a lock on the domains it alleges have questionable content, preventing the owner from transferring them to another registrar.
SlicksNetwork.com’s owner Slick said that directNIC does not host his sites, it just serves as the registrar. SlicksNetwork.com contains 14 TGP sites that link to sponsor programs.
According to the owner of SlicksNetwork.com, directNIC has pinpointed the first 14 thumbnails on its site MajorPervert.com, as containing images of girls that do not appear to be of age. DirectNIC counsel said that if SlicksNetwork.com disputes that the models are underage, it must supply the registrar with photo IDs and birthdays, putting the burden of proof on squarely on the site owner, a secondary producer.
First Amendment attorney and Free Speech Coalition Chairman Jeffrey Douglas said the ID request is unprecedented, and more importantly, a violation of privacy laws. According to Douglas, the request is illegal, and also could have a chilling effect on the free speech of webmasters that deal in legal teen content.
“This is a blatant and absolute violation of privacy laws,” Douglas told XBIZ. “There’s absolutely no legal liability for the registrar if underage models appear on a website. DirectNIC is an officious intermeddler.”
Upon receiving a complaint of child pornography, there are legal courses of action for directNIC to take, Douglas said. Since it has no legal right to obtain personally identifiable information from the website’s models, the company should have alerted the proper legal authorities, but instead it decided to take the law into its own hands.
The FBI, the Association of Sites Advocating Child Protection (ASACP) and the National Center for Missing and Exploited Children operate hotlines for the reporting of child pornography.
“The bottom line is that if [directNIC] received a complaint about child porn, there are a numerous avenues for them to report it to the proper legal authorities,” Douglas said. “DirectNIC has no remote prayer to legally justify their request. They are licensed to provide a service — not to police content. I would think that upon hearing this, most adult companies would transfer their domains [away from directNIC] immediately.”
Douglas continued, “Again, under federal law they have no right to these documents, so now they have no protection from civil liability. They are immune from policing content under the law, but now by doing so they have created liability. DirectNIC is lawlessly intruding into their business.”
According to directNIC General Counsel David W. Nance, upon receiving a warranted complaint of child porn, the company takes action by either immediately shutting down the domain or conducting an investigation.
“In most cases when there is a confirmed report of child porn, directNIC takes immediate action and shuts down the domain names because it is blatantly obvious that the customer is offering child porn,” Nance told XBIZ. “However, not every case is clear cut. The letter was intended to notify the customer of the potential issue that was reported to directNIC. This does not mean that the domains contain child porn; it only means that an investigation was commenced — i.e., we want to make sure that we do not facilitate the trading of child porn online.”

Doctor Says Surfing XXX is OK

KUALA LUMPUR, Malaysia — More and more citizens of the Malaysian state of Kelantan are surfing for triple-X websites, bucking the trend in the mostly conservative country.
Studies show that surfers in Kelantan topped the list of surfers who frequented pornographic websites. Popular searches include "nudity," "nude pictures," "sex with Malaysians" and "sex stories."
Despite some conservative alarm at these studies, Malaysian psychologist Jas Laile Suzana Jaafar says that the behavior is perfectly normal, especially in a place where there are sexually oppressive politics at play.
"If a teenager was the one who searched for it, it is normal because of puberty, and he has to learn about sexuality to understand the changes they experience," she said. "If teenagers ask their parents or peers, how much information can they get? In Kelantan, parents are not open to talking about sexuality with their children."
Jaafar said that some studies suggest that surfing for adult sites can be addicitve, but she added that the studies didn't tell the whole story.

FTC to Scrutinize Viral Marketing

WASHINGTON — The Federal Trade Commission said it will take a closer look at viral marketing campaigns in an effort to better protect consumers against possible instances of fraud and false advertising.
In a staff opinion, lawyers for the FTC, which has the power to oversee advertising, said for the first time that the agency would monitor and investigate incidents of fraud and deception using the fast-growing online marketing tactic.
In Oct. 2005, Commercial Alert, an advertising and marketing watchdog group, petitioned the FTC to take action against viral marketers. Citing viral marketing campaigns employed by T-Mobile and Procter & Gamble as possibly deceptive, the group asked the FTC to issue guidelines for viral marketers requiring paid agents to disclose their relationship with the company whose product they are promoting.
Viral marketing has quickly become a popular tool for online advertisers, who encourage users to plug products on Internet properties ranging from MySpace pages to blogs.
Under current FTC rules, word-of-mouth advertising — the most analogous tactic to viral marketing — is governed by regulations that deal with commercial endorsements. The FTC’s staff opinion clarifies the rules by noting that viral marketing could be considered deceptive if consumers were more likely to trust the product’s endorsers “based on their assumed independence from the marketer.”
“We wanted to make clear, if you're being paid, you should disclose that,” FTC Associate Director for Advertising Practices Mary Engle said.
The FTC said it would investigate alleged violators on a case-by-case basis by issuing cease-and-desist orders, fines and civil penalties.
To date, the FTC said it has not brought actions against any viral marketers.
“This letter tells marketers like Procter & Gamble that their 'sponsored consumers' must disclose that they are shilling, or they are probably in violation of the prohibition against deceptive advertising,” Commercial Alert Executive Director Gary Ruskin said. “That's big. “It will change practices in the word-of-mouth marketing industry.”

Senator Proposes Mandatory "Obscenity" Reporting for Blogs, Mailing Lists, and Beyond

WASHINGTON, DC -- Webmasters and web denizens who thought things got confusing and paranoid after the government strengthened and began enforcing its 2257 regulations may look back on those days with fondness if Sen. John McCain (AZ-R) gets his way.Legislation drafted and presented by McCain would require that commercial websites, as well as personal blogs, mailing lists, and more, conform to federal obscenity reporting guidelines or face fines of up to $300,000. Fear of such a possible development was likely behind the massive policy changes that community building websites such as Tribe.net underwent earlier in 2006 and, given some of the bill's requirements, such fear may not have been misplaced. McCain's proposal, emotionally named the "Stop the Online Exploitation of Our Children Act," affects, among other things, any internet presence that offers user profiles by forcing them to delete pages belonging to sex offenders, apparently with no consideration given to what their offense was or whether they have served their time. According to McCain during a speech on the Senate floor, these changes are necessary because "technology has contributed to the greater distribution and availability, and, some believe, desire for child pornography." No mention was made about those offenders whose crimes involved adults or mutually consensual, but illegal, activity. Additionally, the proposed law mandates that any form of suspected "obscenity" or child pornography be reported to National Center for Missing and Exploited Children, with that information being forwarded to the appropriate legal authorities. Webmasters would be required to retain any "information relating to the facts or circumstances" for a minimum of six months. Those who report suspected criminal activity would be immune from civil or criminal liability under the proposed law, so long as they followed the specified procedures precisely.Internet Service Providers are already required by law to report suspected child porn or obscenity, but McCain increases penalties and expands regulation to not only commercial web presences but to individual bloggers or those who provide bulletin board discussion areas and user forums on their websites. The Electronic Freedom Foundation was quick to condemn the proposal, with attorney Kevin Bankston stating that he was "concerned that there is a slipper slope here," according to News.com. "Once you start creating categories of industries that must report suspicious or criminal behavior, when does it stop?" he asked.While the answer to Bankston's question is unknown, what is known is that McCain's proposal would mandate reports from any content hosting service, any website with a message board, any social-networking site, any email service, any instant-messaging service, any chat room, any domain name registration service, any internet search service, any electronic communication service, and any image or video-sharing service. An anonymous McCain aid stated that any site or service that "you'd have to join up or become a member of to use" regardless of free or pay status would fall under the proposed law's jurisdiction. This includes, but certainly is not restricted to, so-called "social-networking" sites such as MySpace, LiveJournal, Friendster, as well as other membership sites including Amazon.com, Slashdot.com, Gamespot.com, CNET.com, MP3.com, and any other site that allows public profiles. Although some, including Kate Dean of the U.S. Internet Service Provider Association says that the organizations membership appreciates McCain's work to make reporting procedures more clear, others believe that the involvement of private individuals will make things more complex, in part because what constitutes child pornography is not entirely certain. The recent indictment of Alabaman photographer Jeff Pierson on child pornography charges, for instance, indicates that nudity is not required for an image of a minor to be deemed pornographic. Pierson's work features clothed underage models deemed "provocative" by prosecutors -- but taken with parental consent.The bill would also create a federal registry containing "any email address, instant-message address, or other similar internet identifier" possessed by anyone convicted of a sex crime. Those who refuse to provide the government with this information would face penalties of up to a decade in prison. The information would then be used, presumably, by membership sites forced to purge themselves of anything "associated" with that person.Regardless of Attorney General Alberto Gonzales' recent political grandstanding on the topic, studies have shown that the online solicitation of minors has dropped during the past five years, even while social-networking sites have increased. Because of this, Bankston insists that "This constitutionally dubious proposal is being made apparently mostly based on fear or political considerations, rather than on the facts." Such concerns do not appear to be of interest to Congress, however, given that the Deleting Online Predators Act, another fuzzily worded bill that appears to target social-networking sites without actually defining its terms, was approved this past summer by the U.S. House of Representatives in a 410 - 15 vote.McCain, who scored 31 points out of a 100 point total in a News.com election guide concerning technologically friendly legislation, will be in good company during the coming year. Gonzales and the FBI intent to continue to push for mandatory ISP data retention and Sen. Chuck Schumer (NY-D) plans to join McCain by jointly introducing anti-sex offender and social-networking legislation in January.

New Anti-Rape Condom

Hear, hear. In an effort to curb one of the highest rates of sexual assault in the world, a South African inventor has unveiled a new anti-rape female condom that hooks onto an attacker's penis. Thanks to Banderas News for the heads-up on this one.
Sonette Ehlers, 57, invented the "rapex," which is inserted much like a tampon and also helps prevent pregnancy and disease transmission in the same way that a standard female condom does. The latex device clings to the penis with shafts of sharp barbs. Once attached, only surgery can remove it, which will alert hospital staff and police to the attacker.
But here's the catch: A South African anti-rape organization opposes the device. Sam Waterhouse of advocacy group Rape Crisis offered this critique:
"If a victim is wearing such a device it may enrage the attacker further and possibly result in more harm being caused," he said.
Apparently some other groups argue that the device is barbaric -- this with rape on the other side of the coin. Police reports in South Africa show 50,000 reported rapes every year in the country, while the conventional wisdom suggests that many more go unreported.
"Nothing has ever been done to help a woman so that she does not get raped, and I thought it was high time," Ehlers said.

While there's nothing "in hand" to play with at the moment, unless you are a Web application developer or part of the Mozilla testing community, just the knowledge that Gran Paradiso Alpha 1 - which it has been dubbed - is enough to get any Firefox-phile's excitement levels up off the charts!As one might expect, Firefox 3 will include many significant changes - not the least of which is the inclusion of Gecko 1.9 which itself has not been released. The Gecko rendering engine has been in development since long before the release of Firefox 2 and provides vector-based rendering on all platforms and includes the Cairo graphics layer. Cairo (wiki.mozilla.org/Cairo), as described in detail in the plans for Gecko 1.9, is said to "bring modern, hardware-accelerated 2D-graphics capabilities to the whole of the Web without requiring proprietary plug-ins or rendering obsolete the broad and rich set of Web-authoring techniques developed over the past decade."Unfortunately, with such improvements come a few downfalls. As technology grows, older versions and programs tend to be left behind. At this point in development it has been determined that Firefox 3 will not work on the 95, 98 or ME versions of Microsoft Windows - nor will it work on Mac OS X 10.2.Other improvements include an updated threading model, updates to the browsing, book-marking and privacy features as well as potential slight changes to layout as needed in order to retain usability. Naked News Travels to Hollywood for ‘Raw Talent’ Search

HOLLYWOOD, Calif. — Naked News has kicked off a nationwide search for its next broadcaster.
Correspondent Lily Kwan is leading the network’s “Raw Talent” search, which will conclude by early February.
Kwan is in Los Angeles to lead PR efforts for the search. The London-based journalist also plans on reporting today from Hollywood — where she will eventually strip — the first Naked News trip to Southern California since 2004.
With the search, finalists will be flown to New York for media exposure, and the winner will be offered a full-time contract at the Toronto-based Internet and cable network.
“The contest is based on personality, presentation, stage presence, poise, beauty and appeal,” Naked News CEO David Warga told XBIZ. “Contestants will be judged by local radio personalities to determine a finalist from each region.”
Warga said that its Internet segment has reached more than 3 million subscription-paid viewers.
Naked News began in 1999 as an Internet phenomenon. The subscription website features news anchors stripping or fully nude as they broadcast the day’s headlines. “Naked News TV” is an offshoot pay-per-view or subscription service. Naked News clips are available on mobile devices through Amp’d mobile in the U.S.
