New Pill Stops Ejaculation

LONDON — British scientists have begun work on a pill that men can use as a one-off contraceptive before going out on a date. They claim that the pill can prevent a man from ejaculating but within a few hours his fertility and function would return to normal.
The latest male pill was inspired by two medicines that were previously in use for the treatment of high blood pressure and schizophrenia. Both of the medicines had side effects that prevented ejaculation in users.
Scientists hope to have it on the market in as little as five years. Scientists working on the project say that potential side effects include drowsiness and dizziness.
But Dr. John Amory, an associate professor at the University of Washington's medical school, says this new drug may have other, more dangerous side effects. Amory is currently working on another male contraceptive project.
"It's an interesting idea, but so far has not even been tested in animals -- only in the Petri dish," Amory told XFANZ in an e-mail. "Also, the medications they are using are not benign.”
Amory said that two of the drugs in the new pill can cause retinal damage and low blood pressure.
Adult star Peter North, who is known for his superabundant ejaculations, is also dubious of the new pill.
"I can't speak from any scientific point of view, but I would tend to think that controlling something like that would have an adverse affect on the libido in the long run," he told XFANZ. "In the logical way of thinking, I can’t see it not having a long-term effect down the road. I mean, who wants to be the guinea pig on that one?"
According to FreeRepublic.com, the new pill, which would be available in a tablet form, will contain chemicals that prevent ejaculation altogether, although men's fertility and function should return to normal within a few hours of stopping treatment.
"The big test would be if it worked on me," North laughed.

Durex Cites Sex Toys as Reason for Sales Surge

LONDON — Sex toys are a major profit center, according to British condom maker Durex, which attributed an 18 percent increase in sales to adult novelties.
Durex, which is owned by SSL International, earned nearly $25 million in sex toy sales, a 9 percent increase over last year’s totals.
Durex said a vibrating penis ring, a spaceship-shaped stimulator and a “tingle” condom helped drive the strong sales.
SSL CEO Garry Watts said Durex plans to launch a slew of new adult novelty products in the coming year, adding that a TV ad throughout Great Britain should help bring the company’s message to a broader audience.

French Add Condoms to XXX

PARIS — Condom-free adult films on French cable TV are drawing their last breath.
French broadcasting watchdog High Audiovisual Council, or CSA, implemented stricter rules for the country’s nine cable TV stations that are allowed to show adult films. Under the rules, which take effect next year, unprotected sex will not be allowed.
Condomless sex is banned because it sets a dangerous example and promotes “delinquent behavior,” according to the CSA. The group noted that adult films rarely show sex between partners in committed, lasting relationships.
The CSA’s new rules were prompted by the AIDS awareness organization Act Up, which pressed the broadcast regulatory agency for the change.
“The risks actors take by having unprotected sex during filming are real,” Act Up wrote in a letter to CSA. “These films trivialize and possibly glorify risky sex.”
Adult movies ordered on demand will not be affected because those channels are not covered by the CSA’s purview.

Google Infringement Case Likely to Be Decided in January

BRUSSELS — The judge in the Belgian copyright case against Google Inc. said she will deliver her verdict after the Christmas break.
The announcement coincided with Google’s settlement with two of five groups that seek to prevent Mountain View, Calif.-based Google from linking to Belgian newspaper articles.
The case is being looked at closely by numerous adult webmasters who, like the Belgian papers, say they are being infringed upon because the search engine giant displays their content without paying them or asking their permission.
What’s more, many webmasters complain that most search engines do not make it clear to searchers that the images they find are not public domain property, leaving images vulnerable to theft.
In a similar suit in the U.S., adult content publisher Norman Zada, who owns Perfect 10 magazine and its sister website, charges that Google’s Image Search violates U.S. copyright law because it allows the search engine and other companies to profit from the use of his content without permission. That case is currently before the 9th U.S. Circuit Court of Appeals in San Francisco.
In the Belgian case, Google failed to appear at an earlier court date that saw a judge order Google to remove newspaper content from its news index, threatening daily fines of $1.3 million until it complied with the ruling. A judge for the Tribunal des Referes in Brussels later agreed to give Google another hearing.
Attorneys for Copiepresse, which represents 17 newspapers, claimed Google hurt the rights of authors because it effectively gave away free archived articles they sell on a subscription basis.
But Google counsel accused the newspapers of protectionism, insisting the company hadn’t broken copyright law by showing headlines, a few lines of text and a link to the original story.
Google also has run into trouble in Scandinavia, where it launched several weeks ago. It delayed the introduction of the news service in Denmark after publishers there objected to having to opt out if they didn’t want their content displayed on Google’s website. Also, a publishing group in Norway has protested the use of its photographs, which it says is not permitted under Norwegian copyright law.

Spam on Rise, Say U.S. Security Firm, European Commission

REDWOOD CITY, Calif. — Two new studies show that unsolicited spam emails remain a growing global problem.
U.S. email security firm Postini also issued a bleak report on spam, finding that the number of unwanted messages has tripled since June, and that it currently accounts for 91 percent of all email.
“This dramatic rise in spam attacks on corporate networks has the Internet under a state of siege,” said Daniel Druker, executive vice president of marketing at Postini. “Spammers are increasingly aggressive and sophisticated in their techniques, and protection from spam has become a front-burner issue again. Spam has evolved from a tool for nuisance hackers and annoying marketers to one for criminal enterprises.”
Spammers are also continuously evolving their tactics, Druker said. Image spam and Microsoft Office document spam now makes up as much as 30 percent of all junk messages, up from 2 percent in 2005.
The study also describes the lengths hackers go to send spam that has a greater chance of bypassing updated corporate anti-spam filtering technology. Hackers use techniques such as re-arranging as many as 25 tiny images into an email message, or use animated GIF attachments to bypass filters.
Postini has detected 7 billion spam emails in November, compared with 2.5 billion in June. The company tracked a 59 percent spike in spam from September through November, and the daily volume of spam rose by 120 percent over the past year.
According a new study from the European Commission, spam messages are choking servers and accounting for between 50-80 percent of all sent emails. The commission also determined the financial impact of spam to be $51.1 billion worldwide in lost productivity, new filtering technology purchases, network upgrades and other associated costs. Spam costs firms up to $1,000 per employee.
EU media commission Viviane Reding implored EU governments to step up to the plate to pass legislation against spam. The EU report found that only the Netherlands and Finland were making progress against spam by enforcing a 2002 law.
A EU spokesman said the Dutch were able to enforce compliance with the law by implementing fines. EU officials are working on drafting tougher legislation, which it will push for next year that would make it easier to prosecute spammers.
Additionally, the report said that the U.S. accounts for 21.6 percent of all spam coming into the 25-country EU. China was the second biggest producer with 13.4 percent.

Global Sex Study Uncovers Naked Truths, Contradicts Myths

LONDON -- Regardless of what extremists would have the world believe, it doesn't appear to be going to hell in a hand basket; at least not sexually. Not according to the results presented by the first-ever globally comprehensive study of sexual behavior.According to the study's British researchers, rumors that people are giving up their virginity younger than ever are unfounded. Likewise, claims that married people have sex less often than their unmarried friends are also untrue. Best of all, especially for those unmarried friends, is that there does not appear to be a firm connection between how often a person has sex -- or with how many people -- and the transmission of STDs. Professor Kaye Wellings of the London School of Hygiene and Tropical Medicines, and an assortment of professional colleagues, looked over published studies about sexual behavior conducted during the past decade in 59 countries, as well as governmental data, before writing the final draft of their study and submitting it to the British medical journal The Lancet. The researchers and experts on sexuality hope that the study will be helpful to professionals who need solid and reliable information for developing effective programs regarding sexual health throughout the planet. As of now, many policies and programs rely upon stereotypes and myths about sexual conduct, as opposed to real world research. Wellings admits that she and her comrades even had some of their cherished personal opinions challenged by the survey's results, which included self-reports. Among them was an expectation that they would find rampant promiscuity in regions of Africa, where STDs including HIV/AIDS are rampant. The truth was otherwise, with multiple sexual partners being reported in industrialized nations where STDs are far less common. Although initial logic may suggest that the more partners one has sexually, the more likely one is to contract an STD, Wellings believes that the evidence points to two more insidious culprits: poverty and lack of education. She believes that it is this due which leads to decreased use of condoms, lack of understanding about their value, and ignorance surrounding how STDs are transmitted and protected against. In fact, the survey provided researchers with data suggesting that African men and women are far less sexually active than expected. Only two-thirds of those involved in the study reported recent sexual activity, compared to three-quarters of men and women involved with the study but located in developed countries. Among other popular sex myths blown out of the waterbed by the study is the belief that sexual activity in the young is beginning earlier than ever. What Wellings and her associates found instead was that in nearly every region of the world, reporters listed their first sexual encounter most often as happening in their late teens, from 15 to 19-years-old, with men more likely to begin exploring partnered sex later than women. They did find, however, that some areas varied from others. For instance, in the United Kingdom, men reported their first partnered sexual activity beginning at about 16 1/2 years of age, and women reporting theirs to have begun at 17 1/2 years of age. Indonesian men, on the other hand, waited until they were 24 1/2 years old, with Indonesian women reporting their first shared sexual contact taking place when they were 18 1/2 years old.Married sex got a PR boost from the study, as well, with the idea that marriage is the cure to sex taking a big blow. Instead, the researchers found that married couples engage in sexual activity more frequently than singles. This is of additional interest, given that more and more people worldwide are delaying marriage until later in life. While the academics agreed that this meant more unmarried people are having sex before marriage, they did not conclude that it meant they were engaging in riskier behavior while doing so. In fact, depending on their circumstances, married women were found to be at a greater risk for harm than single women.Dr. Paul van Look, director of Reproductive Health and Research at the World Health Organization, explains that, "A single woman is more able to negotiate safe sex in certain circumstances than a married woman." Examples include Asia and Africa, where husbands who frequent prostitutes and do not use condoms place their faithful and unsuspecting wives at risk of infection. By contrast, more developed nations saw a greater equality between the number of partners that men and women each enjoyed, although the rate of STD risk was not higher than that found in nations were higher numbers of lovers are more obviously gender-related. Women and men in Australia, Britain, France, and the United States, for instance, report more equal numbers of sexual partners. Not so in countries including Haiti, Cameroon, and Kenya, where men often have multiple partners while women have only one -- and STDs are a major concern.In Wellings' opinion, this information has incredible public health and policy making implications. "In countries where women are beholden to their male partners, they are likely not to have the power to request condom use, and they probably won't know about their husbands' transgressions," she points out. "There are very different economic, religious, and social rules governing sexual conduct across the world," she explains -- and those in charge will both be affected by those rules as well as need to work around and within them.

Critics Debate Proposed Australian Copyright Law

SYDNEY, Australia — Critics of a copyright proposal in Australia have warned that its passage could result in serious penalties to users of video sharing sites like YouTube.
The proposed law, which is currently being debated in Australian Parliament, would make it an indictable offense for someone merely to possess a device with the intention of using it to infringe copyright. Under Australian law, all indictments must go before the justice system. The existing system allows copyright infringements to be settled by paying damages to the copyright holder without involvement of the courts.
“It has the potential to make everyday Australians in homes and businesses across the country into criminals on a scale that we have not witnessed before,” said Brian Fitzgerald, head of Queensland University’s law school. “The proposal could potentially cover a 14-year-old girl videoing herself lip-synching to her favorite pop tune and uploading this to a video-sharing website.”
Electronic Frontiers Australia, a free speech advocacy group, said the proposal also extends the list of items potentially used for copyright theft to include video players, music players, home computers and other personal devices.
“One section [of the proposal] would arguably make distribution of copyright material via the Internet a criminal offense, even where the person responsible had not intended such distribution to occur,” the group said in a statement.
Attorney General Philip Ruddock has not responded to these claims but has said the proposed law is intended to catch and punish major music and movie pirates, not personal users.
Politicians and experts are debating the proposal in Parliament before a final version is put to vote, which is expected to be some time next year.

Phallic Sculpture Flap

TAIPEI, Taiwan — Some foreign visitors and flight crew have demanded the removal of a giant wooden sculpture of a penis on display at Taipei’s international airport.
The sculpture is part of an exhibition of items from the Thou tribe, one of Taiwan’s ten tribes, and it has been referred to as “The Thing” by foreign crew members and flight attendants.
Some offended people have posted photos of the sculpture on their websites.
Representatives of the Taoyuan International Airport were going to move the sculpture to a quieter corner of the exhibit, but the Thou tribe refused, saying that, since ancient times, the giant phallus has been used to appease their region’s female “mountain god,” who will unleash rocks and mudslides if angered.
The Thou tribe also pointed out that some Japanese people also worship phallic sculptures as fertility symbols and that many Japanese visitors to the airport have posed for photos with the sculpture, as reported in the Asia Pacific News.
Airport authorities are weighing their options as to what the final outcome will be concerning the phallus.

U.K. Removes Denial-of-Service Attacks from "Legal Gray Area"

UNITED KINGDOM -- If you're thinking of launching a denial-of-service attack against a person or group that you don't like, they'd best not be in the United Kingdom or you could get into big trouble.Although experts say that the attacks had previously existed in "a legal gray area," lawmakers have changed that, making it an offense to hamper the ability of any computer system to operate. The Police and Justice Bill 2006 supercedes the previously applicable Computer Misuse Act 1990 (CMA), which was created prior to common use of the internet. The bill, given Royal Assent earlier this month, also includes clauses prohibiting behavior that denies users access to programs or data stored on a computer, or interfering with the ability of any data or program stored on a computer to operate. Violators of the new law now face maximum cybercrime penalties of up to 10 years in jail, as opposed to the previous five.The CMA had only prohibited unauthorized modification of computer systems, and not the rendering of an entirely computer system inoperable via data overload, thus leaving denial-of-service attacks in the aforementioned "legal gray area." This has been used as a defense by individuals who might otherwise have been convicted of cybercrimes, including David Lennon, whose mailing of 5 million emails to his former employer caused the email server to crash. His successful November 2005 argument stated that since an email server exists to receive email, the number of emails sent to it, no matter how large, could not be deemed an unauthorized modification to it. The case was later overturned and Lennon sentenced to two months' electronic tagging with an enforced curfew.

Google Trends: Porn Popular in Utah

SALT LAKE CITY — Some webmasters might be surprised to learn that many users who visit their sites based on Google search engine results live in states such as Utah, according to a newspaper columnist in the state.
Matt Homer, a columnist for the Daily Utah Chronicle, used Google Trends and got what he called “bizarre results,” finding that Salt Lake City users are searching for “pornography,” “repentance” and “fry sauce” at a greater rate than any other location in the U.S.
Google Trends allows users to track keyword searches by location. Users enter a keyword and Google Trends tells them which locations use that keyword most frequently.
Homer said he decided to use Google Trends to verify reports that Salt Lake City ranks No. 1 in the U.S. for pornography searches.
“Salt Lake City ranks first in the nation for searches using the term ‘pornography,’ but only fifth in the entire world,” he said. “Who searches for ‘pornography’ more than we do? India. Enter a few off-color words and, before long, you'll notice something eerily nasty about the land of curry.”
While Homer’s study was not scientific, he did note that users seemed more than comfortable searching both for pornography and so-called conservative keywords.
Salt Lake City ranks in the top 10 for the following searches: “President Bush,” “patriotism,” “Fox News,” “marriage amendment,” “Sean Hannity” and “American flag.”

Lawyer: No Spears Tape

LOS ANGELES — Mark Vincent Kaplan, Kevin Federline's attorney, said that there is no Federline-Britney Spears sex tape.

DOJ, ACLU Make Closing Arguments in COPA Case; Judge’s Ruling Expected in Early ‘07

PHILADELPHIA, PA – Attorneys for the American Civil Liberties Union presented their closing arguments Monday in the case ACLU v. Gonzales, the ACLU’s legal challenge of the Child Online Protection Act (COPA), legislation signed into law by then-President Bill Clinton in 1998.The DOJ and ACLU relative positions in the case are both clear and diametrically opposed. The DOJ, for example, argues that internet "filters" are insufficient to achieve the stated goal of “protecting” children online and COPA is needed in order to mitigate the damage that “material harmful to minors” does to children surfing the internet.The ACLU, on the other hand, observes that as COPA cannot be applied to pornography and other “harmful” materials hosted on foreign servers and/or that are posted on sites that are non-commercial, COPA would substantially fail to provide any meaningful protection to children.Also at issue is the ACLU’s contention that COPA is worded in a fashion so vague and with standards so expansive that a wide variety of non-pornographic, non-obscene speech could be subject to the terms of the Act and potential criminal liability for failing to comply with a law ostensibly designed to keep children from accessing online pornography. The end result of such overreaching on the part of COPA’s verbiage, the ACLU argues, is the chilling of a substantial amount of speech that is presumed to enjoy the protection of the First Amendment.“Since Congress passed this law, the Internet has changed and it is now clear that this harsh, criminal law won’t come close to achieving its goals,” said Chris Hansen, a senior staff attorney with the ACLU. “It is also clear that other alternatives, including education and filtering, are far more effective for those parents who want to limit access by their children to certain websites using their own values.”Over the past four weeks of hearings, government attorneys and their expert witnesses have been attempting to make the case that filters are incapable of blocking enough content that is “harmful to minors” to be a sufficient protection tool on their own, while simultaneously arguing that filters detract from the educational process by blocking material that is not harmful to minors.According to the research and testimony of University of California, Berkeley statistics professor Philip B. Stark, one of the expert witnesses testifying for the DOJ, the strictest Web filter tested in Stark’s research, AOL’s “Mature Teen” filter, blocked 91-percent of the sexually explicit websites indexed by Google Inc. and Microsoft’s MSN. Less restrictive filters blocked a little over 40-percent of such sites, according to Stark’s study, Stark’s research also indicated (by extrapolating from a random sample) that 1.7-percent of search results supplied by AOL and Yahoo are “sexually explicit,” as are at least 1.1-percent of sites indexed by Google and MSN.Around six-percent of all searches return at least one sexually explicit website, according to Stark, and the most popular search terms yield such a site close to 40-percent of the time.Hansen counters that however “ineffective” the government may deem software filters to be, the nature of COPA renders the law far less effective.“Filters are more than 90-percent effective, according to Stark,” Hansen said recently, during a break in the trial. “COPA – right out of the bat – doesn’t block the 50-percent(hosted) overseas. So, COPA is substantially less than 50-percent effective.”“Also, with filters, it’s up to the parents how to use it,” added Hansen, “whereas COPA requires a one-solution-fits-all (approach).”The evidence submitted during the hearings, in particular some of the evidence rejected by Judge Lowell A. Reed, appears to support some of the ACLU’s claims concerning COPA’s weaknesses.At the close of the November 15th hearings, attorneys for the DOJ attempted to enter into evidence “an overseas prosecution of events which occurred outside of the United States concerning internet websites where the wagerers gambled almost exclusively from the United States,” as described by DOJ attorney Kenneth E. Sealls.The case in question that the DOJ wanted to enter into evidence is US v. BetOn Sports, which is, as of this moment, simply an indictment.Hansen objected to the inclusion of the BetOn Sports indictment, on the grounds that the case is not relevant to COPA and, as the case has not been adjudicated, the indictment lacks any probative value.Sealls countered that the indictment contains “language which is a situation which we present as almost analogous to the type of law that COPA is insofar that COPA’s overseas reach, we submit, would govern out-of-the-country internet websites where the activity is conducted from persons in the United States.”“This is, your honor, something that shows that the Department could extend overseas the application of COPA,” Sealls added at a hearing last Wednesday.When Judge Reed noted that the exhibit was “merely an indictment, not an adjudication and the statute language is not identical,” and pressed Sealls for reasons why it should be included, Reed conceded that was an accurate assessment, but argued that fact “really goes to the weight, not the admissibility (of the evidence) insofar that the indictment means that there was a prosecution brought.” Sealls argued that while the statute in question is not COPA, and there has been no conviction or ruling of any kind by the court in the case, the case nonetheless serves as an example of the “overseas reach of a criminal statute concerning the use of the internet by persons in the United States when the transmission is coming from overseas.” Judge Reed wasn’t persuaded by Sealls’ assertion that the BetOn Sports indictment was relevant or probative, and characterized Sealls’ argument as “the most bizarre way to prove a legal argument."“All it proves is that the Department of Justice – the United States of America, rather – has brought such a claim in its prosecutorial role in the United States,” Judge Reed observed. “That is all that it has proved. There is no binding effect. It has no legal – you could not rely on it in an argument before the court of appeals. It’s not binding on anybody. It’s not a published opinion. I fail to figure out the relevance.”Sealls reiterated the DOJ’s position that the indictment was relevant, insofar as it demonstrated the DOJ’s “course of conduct” with respect to another internet-regulatory statute.Judge Reed said that while he was “reluctant to turn down any evidence that may be helpful... I can’t figure what in the world I would do with it, quite frankly.” Adding that he was “not annoyed in any way,” Judge Reed nonetheless noted that the he wasn’t sure that “the course of conduct of the Department of Justice is an issue in this case,” and declined the exhibit on the basis of relevance, sustaining the ACLU’s objection.In a press release issued by the ACLU yesterday, the ACLU stated that Judge Reed’s ruling in the case is expected “in the next few months.”

News Gets Worse for iBill’s Parent Company

DEERFIELD BEACH, Fla. — Interactive Brand Development’s business activities have slowed so much that the company in the last quarter saw a cash overdraft of $104,000, while it struggled with a working capital deficit of $32.4 million.
iBill’s parent also revealed in a Securities and Exchange Commission filing that its revenue was only three digits — $133 — in the period July through September. Last week, the company told regulators it made $82,000 in the last six months.
Further, the filing revealed that iBill had summary and default judgments of approximately $4.4 million in adult webmaster cases this year.
XBIZ was unable to reach officials at IBD for comment Tuesday.
The Deerfield Beach, Fla., company dumped its third-party processing services in April through iBill and relies solely on commissions from contracts to resell processing services. But, in the latest filing, the company explains a plan to continue offering preloaded and reloadable debit cards through its Card Stream division to clients who secure loans through other companies, including payday loan company Easy Money Inc.
Earlier this year, IBD struck a deal with LitFunding Corp. to provide marketing to its large customer base, directing potential customers to Easy Money, which Las Vegas-based LitFunding recently acquired.
IBD has been scrambling to quell legal action by unpaid adult webmasters in the past year. The company said it had a client payout balance of nearly $17 million, not counting court judgments.
The company also is disputing a default on a loan from investment bankers IIG Trade Opportunities Fund that has helped the company keep running, despite the high cost of interest expenses.
IBD, in the first nine months of the year, accrued an unpaid interest expense of $1.05 million, and the company is seeking even more capital.
“If we are unable to obtain additional borrowings to satisfy the settlements and judgments [discussed], we may not be able to meet our current operating needs,” the company said in the filing.
The filing also revealed an arbitration award against iBill its subsidiary Media Billing Inc. in the amount of $5.2 million. IBD said the suit involved the original purchase agreement between Penthouse and InterCept, which at one time owned iBill.
IBD said it seeks funds to cover an appeal of the judgment.
“We will need additional funding to satisfy the outcome of the order and appeal,” the filing said.

Too Much Media Releases New NATS

MORGANVILLE, N.J. — Too Much Media has released a new version of its popular NATS backend software with new improvements, updates, corrections and functionality.
With the release of NATS v3.1.14, Too Much Media also changed its support policy and will officially be discontinuing support of all earlier versions of NATS as of Feb. 1, 2007, a company rep said.
The 60-day window gives companies time to switch to the latest NATS version. In order to utilize the new NATS, clients must install MCrypt prior to the upgrade. Additionally, all new installations and upgrades require new license files to be placed on the server.
NATS, also known as Next-generation Affiliates and Tracking Software, is a backend program with customizable tracking and billing features.
NATS runs on the customer’s servers and comes with two different purchasing options: an outright purchase and a monthly rental. A standard NATS system offers options for configuring payment tiers and setting up multiple processor accounts for unlimited types of programs and partnerships.
New to NATS v3.1.14 is an instant payout feature for ePassporte payments. This new feature gives affiliates the ability to execute payouts themselves via a payments.php script, Too Much partner John Albright said.
In the resellers admin panel, Too Much Media implemented an activity report feature. This new report allows resellers to generate a configurable list of affiliate data based on date criteria and statistical filters, such as quantity of raw hits, unique hits, signups and payment amounts. It also allows for the generation of a contact list for poorly performing affiliates, and also to affiliates who are performing well so they can be sent tips on improving, or compliments for a job well done.
The panel also could be used for tax reporting purposes, since webmasters can include dollars earned for a specified period of time and information for each affiliate including name, address and tax ID.

Spears Sex Tape Update

KAHNAWAKE, Quebec — Online sportsbook BetUS.com has entered negotiations for the alleged honeymoon sex video of Britney Spears and Kevin Federline. BetUS has joined two other unknown bidders for the sex tape. The opening price: $50 million.
“I think we’ll have it sorted out by the weekend,” Christopher Bennett, publicist for BetUS, told XFANZ. “We’re aggressively trying to get it. But we don’t know where the other two [bidders] are coming in at. It’s being done with our guys in New York.”
Although Bennett said that BetUS is confident they’ll acquire the tape — the existence of which has not been proved publicly — he pointed out that his firm felt the same way about the Screeched sex video made by former child star Dustin Diamond, which went to Red Light District instead.
“I’m not concerned about us not winning the bidding,” Bennett said of the alleged Spears video. “I’m worried [Federline] will end up not selling it. I think Britney is going to put an offer down and try to block it. I don’t even think it’s going to hit the market at this point. It sounds like [Federline] is just trying to get custody of his kids and get some spousal support. He has to consider which he wants more — whatever he can rake in off this video or roll the dice in divorce court.”
Although Federline initially asked for $50 million, according to Bennett, the BetUS publicist said he believes the video will sell for substantially less than that. The negotiations currently are being held with Federline’s agent, Brian Bunnin of ICM, according to Bennett. Financial arrangements of the deal will have to be approved by BetUS investors before a transaction is concluded.
BetUS believes that Spears’ popularity will result in sales figures that would double those of the Paris Hilton sex video.
“After the Paris tape dropped and became a huge hit, you would think Britney would have gotten rid of the tape,” Bennett said.
BetUS claims to have more than 100,000 members in the U.S. alone for it’s online betting business. If it acquires the tape, BetUS intends to allow its members to see it for free, but will charge non-members $29.95 to download it.
XFANZ reported last week that celebrity sex tape broker David Hans Schmidt also had entered talks to purchase the alleged sex tape.

Google, Yahoo, Microsoft to Use Same Web Indexing Tool

MOUNTAIN VIEW, Calif. — Search engine leaders Google, Yahoo and Microsoft have said they have agreed to increase Internet interoperability by adopting the same web indexing tool. The decision helps webmasters ensure that their sites can be found on each search engine.
Google Sitemaps protocol, a year-old indexing tool, will become the standard for all three companies.
Website operators can use the indexing tool to manually feed their sites to Google and then check to see if their sites have been crawled. Yahoo and Microsoft have similar products, but the decision to unify efforts will allow webmasters to cut down on duplicated efforts, according to Yahoo Director of Product Management Tim Mayer.
“We thought it would be great for publishers and webmasters to be able to submit their content in one format for all the different search engines,; Mayer said. ;We are proposing the format together and inviting other search engines to adopt it.;
According to Mayer, the initial idea came out of cooperation between Yahoo and Google, with Microsoft joining soon after to launch the triumvirate.

MSIE 7 Auto-Updates Begin

Government Study: Approximately 1% of Web Content is Sexually Explicit

According to a study of Internet search queries and a sampling of random Web pages taken from both Google and MSN Search, analysts say that only approximately 1% of all Web pages on the Internet contain sexually explicit materials. The study results were used in Federal Court last week in Philadelphia in a case that was brought against US Attorney General Gonzales by the American Civil Liberties Union (ACLU).The ACLU's position is that the study supports their challenge of the Children's Online Protection Act (COPA) that was signed by President Clinton back in 1998 - an Act that the current Attorney General and other Government Officials are attempting to resurrect. The ACLU believes that the study shows that the Department of Justice is over zealous in its efforts to create criminal penalties in order to protect minors from exposure to adult content sites on the Internet.
The Federal District Court in Philadelphia as well as a Federal Appeals Court found the law to be unconstitutional. Back in June of 2005, the Supreme Court upheld the ban on enforcement of the law as well, however it sent the case back to the Philly district court for more ;fact finding; regarding the use of Internet filters. Catherine Crump, a staff attorney for the ACLU told the press, ;One of the things we think came out of the government's study is that the chance of running into graphic content on the Web when filters are on is extremely low.; In fact, the study showed that only 6% of all queries returned a sexually explicit Web site despite the high-rate of popular sex-related queries posed on the 'Net each day. The data used in this study has seen controversy in the news itself. The data comes from a court order by a federal judge that required Google to turn over 50k random copies of Web pages from its index after a long battle over what Google called ;privacy issues; that would put both its users and trade secrets at risk. MSN, Yahoo and AOL also turned over search query data that assisted in the results of this study. Experts say that the study's overall results reveal that the Internet ;reflects life; and contrary to popular opinion, is not ;more sexual than people are in general.

iBill Parent Claims It Only Made $82,000 in Last 6 Months

DEERFIELD BEACH, Fla. — Unable to collect and prepare its financial data, iBill parent Interactive Brand Development notified Thursday the Securities and Exchange Commission that it could not meet the deadline for its quarterly filing.
Nevertheless, the company, which once did business as a third-party processor but now resells process services, told the SEC that for the last six months of the year it had a miniscule revenue figure of $82,000.
IBD said that the revenue was based solely on commissions from contracts to resell processing services. The company ceased providing processing services in April.
The past several years have been problematic for the public company.
IBD has been scrambling to quell legal action by unpaid webmasters in the past year. In August the company said it had a client payout balance of nearly $17 million. It also said it had court judgments totaling $2.3 million.
The company also is disputing a default on a loan from investment bankers IIG Trade Opportunities Fund.
XBIZ could not reach IBD officials for comment by post time.

COPA Trial Becomes Battleground for Experts

PHILADELPHIA — With the Child Online Protection Act (COPA) trial entering its third week to determine the constitutionality of a law that — if enforced — would require adults to use access codes or credit cards to view material considered to be “harmful to children” online, the Philadelphia Inquirer has reported that the courtroom has become a battle of the pundits, with expert witnesses making the case for each side.
The trial over the 1998 COPA legislation, which provides for $50,000 in fines and up to six months in prison for webmasters who fail to comply with the law, has become a “porn trial without dirty pictures,” Philadelphia Inquirer staff writer Joseph Gambardello said.
In a pretrial ruling, U.S. District Judge Lowell Reed, who is presiding over the bench trial, said the display of adult material would not be necessary in the American Civil Liberties Union Case against the U.S. Government.
Making the case that COPA is an overbroad restriction of protected speech and that filters are a better solution, the ACLU lawyers have called a range of artists, online writers and filtering experts as witnesses in the trial.
Countering the plaintiff’s claim that filtering is an effective way to keep children from viewing adult content, Justice Department lawyers relied on Rutgers University linguistics professor Stephen Neale, who told the court that no filter could succeed in blocking every porn site. Neale also made the point that filters run the risk of blocking legitimate sites. For example, most filters would, likely block a site dedicated to the issue of breast cancer,, Neale said.
On cross-examination, an attorney for the ACLU asked Neale how all porn sites could be blocked?
“Pulling the plug on the web is the only thing I can think of,” Neale said.
In a separate component of the trial, both sides presented witnesses addressing COPA’s mandate that users verify their age with access codes or credit cards.
According to government lawyers, credit cards are an excellent way to safeguard children online. ACLU lawyers made the point that some minors have access to credit cards while many poor adults do not.
One potentially big revelation from the trial, according to Gambardello, was the government’s concession that many of the plaintiffs in the case would be covered by COPA.
The ACLU has taken the lead in the case among a list of plaintiffs that includes Salon.com, Condomania and sex advice site Scarleteen.com. With Justice Department lawyers saying the plaintiffs in the case are not the intended targets of the law, Gambardello said the focus was clearly online pornographers.
Free Speech Coalition Board Chair said he didn’t believe the government’s assertion that some of the plaintiffs would not fall under COPA.
“Because of the vagueness of the definitions in the law, it’s impossible to determine what harmful material really is, which means we don’t know the sites that will be covered,” Douglas told XBIZ. “What they’re really saying is, ‘Trust us; we won’t go after legitimate publications.’ That’s a joke.”
In 1999, Reed issued an injunction against the law, saying there was a “substantial likelihood” that it violated the 1st Amendment. The U.S. Supreme Court agreed with Reed in 2004 when it ruled 5-4 in favor of the plaintiffs. But the high court didn’t completely kill COPA in the ruling, which ordered a trial where the government could make the case that the law is a reasonable restriction on free speech or that the use of filters was a less restrictive alternative that could save the law.
The case is expected to run until the end of November, with a ruling expected some time after that.
